This session will provide an overview of Fed/OSHA’s proposed Heat Injury and Illness Prevention in Outdoor and Indoor Work Settings standard, including:

- A summary of key elements in the proposed rule, such as initial and high heat triggers, monitoring requirements, acclimatization methods, as-needed and mandatory rest breaks, and recordkeeping obligations;
- Highlights from the June 2025 public rulemaking hearing; and
- Insights into potential next steps and a path forward toward promulgation of a final rule.
She will also provide background and updates on state activity to regulate heat illness hazards in the workplace. Many State OSH Plans have already finalized their own heat illness prevention standards or are working toward that goal. Even more notably, several states under Fed/OSHA’s jurisdiction are working on legislation to regulate heat illness in workplaces because Fed/OSHA has not yet issued a rule (i.e., they are not preempted from doing so). Beeta will provide a comparison of federal and state level activities.
Beeta will conclude by describing the work Conn Maciel Carey has done and will continue to do on behalf of its Employers Heat Illness Prevention Coalition to advocate for a heat injury and illness prevention standard that it is effective in its purpose–protecting workers from heat illness hazards–and reasonable in the burdens it places on employers. She will review the Coalition’s major positions, and share how it plans to proceed in the future.
